Campalaluna Terms and Conditions
These Terms and Conditions ("Agreement") govern the arrangement between the hosts, Serotonic and Hailey Jane Jewelry, (referred to as "Host" or "Owner") and the participant (referred to as "Guest" or "Participant") attending the overnight yoga and jewellery camp entitled “Campalaluna” (the “Retreat”) at the Dance Hall Cottage and Point Sylva Cottage and surrounding areas (collectively, referred to as the "Cottage").
1. **Reservation and Payments:**
1.1. Guests must make a reservation in advance to participate in the Retreat.
1.2. A non-refundable full payment is required to secure the reservation. Payment plans are available as agreed to between the parties.
1.3. Payments can be made via a secure online payment platform or other agreed-upon methods.
1.4. Guests must be at least 18 years of age at time of Retreat in order to join.
2. **Check-In and Check-Out:**
2.1. Check-in time is from 3:00 PM on the retreat start date.
2.2. Check-out time is by 11:00 AM on the retreat end date.
2.3. Guest agrees the Retreat term is strictly limited to the above dates and times. Early check-in or late check-out may be available upon request and confirmation from the Host, and subject to availability.
3. **Cottage Guidelines:**
3.1. Guests must follow all Cottage rules and guidelines provided by the Host.
3.2. No smoking is allowed inside the Cottage or within designated non-smoking areas.
3.3. No pets are allowed on the premises.
3.4. Guests are responsible for keeping the Cottage clean and tidy during their stay.
3.5. Damages caused to the Cottage or its property by Guests will be the responsibility of the Guests.
3.6 The Guest agrees to comply with all applicable laws, regulations, and bylaws during the Retreat.
4. **Liability:**
4.1. Guest acknowledges and agrees that the Host will not be liable for any injuries, accidents, illnesses, or losses that occur during the Retreat, as further set out in Schedule A - Release and Waiver of Liability.
4.2. Guests are encouraged to obtain their travel and medical insurance for the duration of their stay. The Hosts insurance does not cover the Guest’s personal belongings.
4.3 Guest releases and discharges Host, its owners, staff and its instructors from any and all liability, claim, demand or action that I may have related to the loss, theft or damage of any of my personal property while at the Cottage.
5. **Yoga Classes:**
5.1. Guests are required to inform the Host of any medical conditions or physical limitations before participating in yoga classes.
5.2. Participation in yoga classes is voluntary and at the Guest's own risk.
5.3. Guest acknowledges and agrees that the Host is not liable for any injuries sustained during yoga classes, including as further set out in Schedule A - Release and Waiver of Liability.
6. **Water Activities:**
6.1. Guests participating in water activities (e.g., swimming, kayaking) must adhere to safety guidelines and wear appropriate life jackets when necessary.
6.2. Participation in water activities is voluntary and at the Guest's own risk.
6.3. Guest acknowledges and agrees that the Host is not responsible for any accidents or injuries related to water activities, including as further set out in Schedule A - Release and Waiver of Liability.
7. **Other Activities:**
7.1. Guests participating in any other Retreat activities (including, but not limited to, pasta making, scavenger hunt, painting and jewelry making) is voluntary and at Guest’s own risk.
7.2. Guest acknowledges and agrees that the Host is not responsible for any accidents or injuries sustained during or related to other activities, including but not limited to those referenced in section 7.1, including as further set out in Schedule A - Release and Waiver of Liability.
8. **Privacy:**
8.1. The Host will respect the privacy of all Guests and will not disclose any personal information without the Guest's consent.
8.2. The Guest hereby grants Host permission to use the Guest’s likeness (photos/ videos) in all publications including social media platforms and their website.
9. **Termination:**
9.1. Host reserves the right to terminate this Agreement and evict the Guest in case of breach of any of its terms or rules. Upon termination, the Guest shall vacate the property immediately. The Guest acknowledges and agrees that there will be no refund of payment on the event of termination.
9.2. In the event of unforeseen circumstances, including but not limited to natural disasters or government restrictions, the Host may cancel the retreat. In such cases, the Host will provide a full refund to the Guests.
10. **Cancellation Policy:**
10.1. Cancellations made by the Guests may result in forfeiture of the deposit or a percentage of the total payment, depending on the proximity of the cancellation to the retreat start date.
10.2. Cancellations made by the Host will result in a full refund to the Guests.
11. **Indemnification:**
11.1. Guests agree to indemnify and hold the Host, its owners, staff and its instructors, harmless from any claims, losses, damages, or liabilities arising out of their participation in the Retreat or use of the Cottage facilities.
12. **Governing Law and Jurisdiction:**
12.1. This Agreement shall be governed by and construed in accordance with the laws of Ontario and federal laws of Canada.
12.2. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Ontario.
13. **Entire Agreement:**
13.1 This Agreement, including the the Release and Waiver of Liability, constitutes the entire understanding between the Parties and supersedes all prior negotiations, understandings, and agreements, whether oral or written. If any term or provision of this Agreement, including within the Release and Waiver of Liability, is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall enure to the benefit of me and my heirs and next-of-kin, and the Host and its successors and assigns.
Schedule A - Release and Waiver of Liability

In consideration of the Hosts permitting the Participant ("I" or "me") to participate in the Retreat, including but not limited to activities such as yoga classes, fitness classes, stand up paddle board, water activities, jewelry making, painting, pasta making, etc. (the “Activities”), and for other good and valuable consideration, I agree to all the terms and conditions set forth below (this "Waiver and Release").
ASSUMPTION OF RISKS
I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES INVOLVE MANY RISKS, DANGERS, AND HAZARDS, INCLUDING BUT NOT LIMITED TO THE RISK OF SERIOUS INJURY, DEATH, OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME ANY AND ALL OF THE RISKS, DANGERS, AND HAZARDS INVOLVED AND THE POSSIBILITY OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE COMPANY OR OTHERWISE.
I hereby expressly waive and release any and all claims which I have or may in the future have against the Host, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, successors, and assigns (collectively, "Releasees"), on account of injury, death, or property damage arising out of or attributable to my participation in the Activities, due to any cause whatsoever, including without limitation the negligence of the Host or any other Releasee, breach of contract, or breach of any statutory or other duty of care owing under occupiers liability legislation or otherwise. I covenant not to make or bring any such claim against the Host or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims.
I SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS THE HOST AND ALL OTHER RELEASEES AGAINST ANY AND ALL LOSSES, DAMAGES, LIABILITIES, DEFICIENCIES, CLAIMS, ACTIONS, JUDGMENTS, SETTLEMENTS, INTEREST, AWARDS, PENALTIES, FINES, COSTS, OR EXPENSES OF WHATEVER KIND, INCLUDING REASONABLE LEGAL FEES, IN CONNECTION WITH ANY THIRD-PARTY CLAIM, SUIT, ACTION, OR PROCEEDING ARISING OUT OF OR RESULTING FROM THE ACTIVITIES.
I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Retreat. I certify that I am physically fit and I have no medical condition, which would prevent my full participation in the Retreat.
I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS WAIVER AND RELEASE AND THAT I AM VOLUNTARILY WAIVING SUBSTANTIAL LEGAL RIGHTS (ON MY BEHALF AND ON BEHALF OF MY HEIRS, EXECUTORS, ADMINISTRATORS, AND NEXT-OF-KIN), INCLUDING THE RIGHT TO SUE THE COMPANY AND THE RELEASEES.
